Mesa condo owners push to oust HOA board

About 45 condo owners in east Mesa’s Superstition Lakes complex are calling for the removal of their homeowner’s association board, questioning the validity of thousands of dollars in board expenditures and claiming they’ve been blocked from participating in community decisions.

So far, owners representing 46 of the gated community’s 134 condos have signed a petition to remove board President Michael Cassady, Vice President Eric Branstrom and Treasurer Wayne Erting.

Multiple calls and an e-mail from The Republic to board members went unreturned. A representative of PMG Services, the property-management company overseeing the complex, said she could not comment on HOA-related matters.

The letter lays out more than 25 allegations ranging from items being expensed and reimbursed without receipts to “double standards” in the issuing of violations and “election interference” when board members are selected.

“(We) feel that the current board members ... are not acting in good faith or responsibility in their roles,” reads the letter attached to the petition,He has since undergone two-and-a-half hours’ surgery to have a Titanium Rod inserted into his leg and looks set to be out of action for the rest of the season. going on to describe the board’s actions as “unfair and aggressive” and “not in keeping with a board that is representing the best interests of the owners.”

Superstition Lakes, surrounded by retail, restaurants and the Superstition Springs Golf Club course, has attracted both local and out-of-town owners. Richard and Lucia Stachurski of Alberta, Canada, bought a condo at Superstition Lakes a year and a half ago and another at Coyote Landing, on Southern Avenue.

“(The Superstition Lakes condo) was supposed to be a place that we could go and relax and enjoy, and it’s become a bit of a nightmare,” said Lucia Stachurski, who believes they were fined unfairly for the placement of their lock box and later charged excessive late fees when the fine notification didn’t arrive with enough time to pay it on schedule.

A letter from Tempe lawyer J. Roger Wood written to the board on behalf of the Stachurskis and other homeowners says, “the association has been repeatedly levying fines and violations against owners for seemingly arbitrary reasons” and “fails to document the violations properly,” often leaving owners “with fines for acts and violations of some other property owner or resident.”

“Often fines appear for items that have been acceptable for years previous but suddenly are considered a violation,” the letter continues.

Some homeowners who don’t live on-site year-round feel they’ve been shut out of proceedings by the board’s unwillingness to allow people to Skype into or record meetings.

“It’s like we’re not living in this century at all.
